TERMS AND CONDITIONS

RECITALS AND BACKGROUND

This Terms of Service Agreement (“Agreement”) is entered into by and between BOOKOURBUS, a registered Partnership Firm under the laws of India, having its principal place of business at D-29, Vibhuti Khand, Gomti Nagar, Lucknow, Uttar Pradesh – 226010(hereinafter referred to as the “Company”, “BOOKOURBUS”, “we”, “our” or “us”) and the User (hereinafter referred to as “you”, “your”, “Customer”, or “Passenger”).
WHEREAS BOOKOURBUS owns and operates an online booking platform accessible at www.bookourbus.com and its mobile applications, providing technology-based facilitation for bus ticket booking and tour package reservations (collectively, the “Platform”);
AND WHEREAS the User intends to utilize the Platform for availing services offered by third-party bus operators and tour providers (collectively, the “Operators”);
NOW THEREFORE, in consideration of the mutual promises and obligations herein contained, the parties agree as follows:

1. DEFINITIONS AND INTERPRETATION

1.1 “Bus Operator” means any independent transport service provider listed on the Platform that offers inter-city, intra-city, or tour bus services.
1.2 “Tour Operator” means any entity offering packaged travel services, including transport, accommodation, and sight-seeing arrangements.
1.3 “Platform” means the website, mobile application, API interface, and any associated digital properties of BOOKOURBUS.
1.4 “Services” means the booking facilitation, payment processing, customer support, and related functions provided by BOOKOURBUS.
1.5 “Ticket” or “Booking” refers to a confirmed seat or reservation issued electronically to the User upon successful payment.
1.6 “User” means any natural person or legal entity that accesses or uses the Platform.
1.7Interpretation: Headings are for convenience only. Words importing the singular include the plural and vice versa; references to statutes shall include amendments thereof.

2. SCOPE OF AGREEMENT

2.1 This Agreement governs the use of the Platform and all Services offered through it. The User’s acceptance of these Terms constitutes a binding legal contract.
2.2 BOOKOURBUS acts only as an intermediary and does not itself own or operate any bus, tour, or vehicle.
2.3 All transport and tour services are rendered by independent Operators who bear full responsibility for licensing, safety, and service quality.
2.4 Nothing in this Agreement shall be construed to create a partnership, agency, or employment relationship between BOOKOURBUS and the Operator or User.

3. USER ACCOUNT AND ELIGIBILITY

3.1 Only individuals aged eighteen (18) years and above who are competent to contract under the Indian Contract Act, 1872 may register on the Platform.
3.2 The User agrees to provide accurate, current, and complete information and to update it as required.
3.3 The User shall maintain confidentiality of login credentials and shall be responsible for all activities undertaken through the account.
3.4 BOOKOURBUS reserves the right to suspend or terminate accounts suspected of fraud or misuse.

4. SERVICES PROVIDED BY BOOKOURBUS

4.1 BOOKOURBUS offers the following services:
 (a) Display of bus and tour options from independent Operators;
 (b) Search, comparison, and real-time availability features;
 (c) Secure payment gateway integration;
  (d) Issuance of electronic tickets and invoices;
 (e) Customer support and grievance redressal.
4.2 BOOKOURBUS does not guarantee seat availability, bus condition, or tour execution and bears no liability for service deficiencies by Operators.

5. RELATIONSHIP BETWEEN BOOKOURBUS AND OPERATORS

5.1 Operators listed on the Platform are independent service providers. They shall obtain all necessary licenses, permits, and insurance coverage.
5.2 BOOKOURBUS does not control the manner or means of service delivery and shall not be deemed responsible for any act, omission, or negligence of the Operator.
5.3 Operators shall indemnify BOOKOURBUS against claims arising from their operations, including accidents or regulatory breaches.

6. BOOKING AND CONFIRMATION

6.1 All bookings are subject to real-time availability as provided by Operators.
6.2 A booking is confirmed only upon receipt of full payment and issuance of an electronic ticket by BOOKOURBUS.
6.3 BOOKOURBUS may levy a non-refundable service or convenience fee for its facilitation services.
6.4 Users are required to verify journey details immediately after booking and report discrepancies to customer support.

7. PAYMENT TERMS

7.1 All payments for bookings on the Platform shall be made using the payment methods integrated and approved by BOOKOURBUS, including debit/credit cards, UPI, internet banking, and digital wallets.
7.2 Prices displayed on the Platform includebase fare, applicable taxes (including GST), and any convenience or processing fees charged by BOOKOURBUS.
7.3Additional charges such as toll tax, parking fees, entry permits, or interstate taxes shall be paid directly by the passenger to the Operator or driver.
7.4 BOOKOURBUS shall not be responsible for transaction failures due to network errors, banking downtime, or third-party gateway issues.
7.5 In the event of a transaction failure after payment deduction, the User must immediately notify BOOKOURBUS at support@bookourbus.com, attaching valid proof of payment. BOOKOURBUS shall verify and initiate a refund within 7–10 working days, subject to reconciliation.
7.6 BOOKOURBUS reserves the right to amend prices or impose additional service charges at any time.

8. CANCELLATION, RESCHEDULING, AND REFUND POLICY

8.1 User-Initiated Cancellations
 (a) Cancellations by the User shall be governed by the specific cancellation policy of the respective Operator.
 (b) Refunds, if applicable, shall be processed after deduction of applicable cancellation fees and BOOKOURBUS service charges.
 (c) No refund shall be applicable for no-show passengers or late arrivals at the boarding point.
 (d) Refunds shall be credited to the original payment method within 7–10 business days, subject to banking timelines.
8.2 Operator-Initiated Cancellations
 (a) In case the Operator cancels a service, BOOKOURBUS shall facilitate refund or re-booking as per Operator’s direction.
 (b) BOOKOURBUS shall not be responsible for consequential losses (such as missed flights, hotels, or appointments).
 (c) Users shall not be entitled to compensation for inconvenience caused by cancellations, delays, or rescheduling beyond BOOKOURBUS’s control.
8.3 Rescheduling of Tickets
 (a) Rescheduling is permitted only for Operators offering that option.
 (b) Fare differences and rescheduling charges shall be borne by the User.
 (c) Once a ticket is rescheduled, it cannot be further canceled.
 (d) Rescheduled tickets remain non-transferable.

9. OBLIGATIONS OF USERS

9.1 The User agrees to:
 (a) Provide true, accurate, and complete personal details;
 (b) Carry a valid government-issued photo identification (Aadhaar, Passport, PAN, or Voter ID);
 (c) Arrive at the boarding point at least 30 minutes prior to departure;
 (d) Verify travel details directly with the Operator before boarding;
 (e) Abide by Operator safety instructions during travel.
9.2The User shall not:
 (a) Use the Platform for unlawful or fraudulent activities;
 (b) Attempt to disrupt, hack, or misuse the Platform;
 (c) Transfer, sell, or reproduce tickets for commercial gain;
 (d) Post defamatory or false content about BOOKOURBUS or its Operators.
9.3 In the event of misuse, BOOKOURBUS reserves the right to terminate or block access without prior notice and pursue legal remedies under applicable laws.

10. OBLIGATIONS OF BUS AND TOUR OPERATORS

10.1 Operators shall ensure compliance with all relevant laws including:
 (a) The Motor Vehicles Act, 1988 and its rules;
 (b) Central Motor Vehicle Rules, and applicable State Transport Rules;
 (c) Tourism Guidelines issued by the Ministry of Tourism (for tour operators).
10.2 Operators shall maintain valid permits, fitness certificates, insurance, and driver licenses at all times.
10.3 Operators shall provide accurate data regarding fares, amenities, and schedules, and shall not misrepresent any service details on the Platform.
10.4 Operators shall be solely responsible for:
 (a) Safety and conduct of passengers;
 (b) Condition and maintenance of vehicles;
 (c) Timely departure and arrival;
 (d) Handling of luggage and passenger complaints.
10.5 In case of any breach, BOOKOURBUS shall have the right to delist or suspend the Operator without prior notice.

11. LIABILITY AND LIMITATION OF RESPONSIBILITY

11.1 BOOKOURBUS acts solely as a technology intermediary connecting Users and Operators. It has no control over service performance or quality.
11.2 BOOKOURBUS shall not be held liable for:
 (a) Delay in departure or arrival;
 (b) Cancellation or deviation of routes;
 (c) Accidents, injuries, or loss of life;
 (d) Condition or maintenance of vehicles;
 (e) Behaviour of Operator’s staff or agents;
 (f) Loss or damage to passenger property.
11.3The User expressly acknowledges that BOOKOURBUS does not provide transportation services and that all travel-related risks lie solely with the Operator.
11.4 The maximum liability of BOOKOURBUS, under any claim arising from any cause, shall not exceed the total booking amount paid by the User.
11.5BOOKOURBUS shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profit, goodwill, or business opportunity.

12. REPRESENTATIONS AND WARRANTIES

12.1 The User represents and warrants that:
 (a) They possess the legal right and capacity to enter into this Agreement;
 (b) They will use the Platform in compliance with all applicable laws;
 (c) They will not use automated tools or bots for fraudulent bookings.
12.2 BOOKOURBUS represents that:
 (a) It is a duly registered Partnership Firm under Indian law;
 (b) It operates a lawful business for booking facilitation;
 (c) It employs reasonable data protection and system security measures.
12.3 BOOKOURBUS does not warrant that:
 (a) The Platform will be uninterrupted or error-free;
 (b) The Operator’s information or services will be accurate or complete;
 (c) The travel experience will meet the User’s personal expectations.

13. DATA PROTECTION AND PRIVACY

13.1 BOOKOURBUS is committed to protecting User privacy in accordance with the provisions of the Information Technology Act, 2000 and the IT (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.
13.2 Personal data collected from Users shall be used only for legitimate business purposes including booking confirmation, communication, service improvement, and compliance with applicable laws.
13.3 BOOKOURBUS shall implement commercially reasonable technical and organizational safeguards to prevent unauthorized access, alteration, disclosure, or destruction of User data.
13.4 BOOKOURBUS shall not sell or disclose personal information to third parties except:
 (a) To Operators for service fulfilment;
 (b) To government or law enforcement authorities upon lawful request;
 (c) To vendors engaged in system operations or payment processing, bound by confidentiality agreements.
13.5 Users shall have the right to review, correct, or delete their personal information by contacting support@bookourbus.com.
13.6 By using the Platform, the User consents to data collection, storage, and processing as outlined in the BOOKOURBUS Privacy Policy.

14. INTELLECTUAL PROPERTY RIGHTS

14.1 All content, design, logos, software, source code, and trademarks available on the Platform are the exclusive property of BOOKOURBUS or its licensors.
14.2Users are granted a limited, non-exclusive, revocable license to access and use the Platform solely for lawful personal purposes.
14.3 Users shall not copy, reproduce, modify, distribute, display, or exploit any portion of the Platform without express written consent from BOOKOURBUS.
14.4 Violation of these rights may result in immediate suspension of access and legal proceedings for infringement under the Copyright Act, 1957 and the Trade Marks Act, 1999.

15. INDEMNIFICATION

15.1The User agrees to indemnify, defend, and hold harmless BOOKOURBUS, its partners, officers, employees, and affiliates from and against all claims, damages, losses, liabilities, and expenses (including attorney’s fees) arising out of or related to:
 (a) Violation of these Terms by the User;
 (b) Use or misuse of the Platform;
 (c) Infringement of intellectual property or third-party rights;
 (d) Negligent or unlawful conduct by the User during travel.
15.2 This indemnification obligation shall survive termination or expiration of this Agreement.

16. FORCE MAJEURE

16.1 BOOKOURBUS shall not be liable for any delay, failure, or interruption in performance caused by circumstances beyond its reasonable control, including but not limited to:
 (a) Natural calamities, fire, flood, earthquake, pandemic;
 (b) Acts of terrorism, war, riots, or civil disturbances;
 (c) Strikes, lockouts, labour disputes;
 (d) Government restrictions, bans, or transportation suspensions;
 (e) Network or system failures beyond its control.
16.2In such events, BOOKOURBUS shall resume operations as soon as reasonably practicable and will not be held liable for any resulting damages.

17. TERMINATION AND SUSPENSION

17.1 BOOKOURBUS may, without prior notice, terminate or suspend access to the Platform if:
 (a) The User violates any term of this Agreement;
 (b) Fraudulent, abusive, or illegal activity is detected;
 (c) BOOKOURBUS is required to do so by law or government order.
17.2Termination shall not affect accrued rights or obligations of either party.
17.3 Upon termination, the User’s right to access the Platform shall cease immediately, and all outstanding dues shall become payable.

18. DISPUTE RESOLUTION AND GOVERNING LAW

18.1 This Agreement shall be governed by and construed in accordance with the laws of India.
18.2In the event of any dispute, difference, or claim arising out of or relating to this Agreement, the parties shall first attempt to resolve the same through mutual negotiation and conciliation.
18.3 If the dispute remains unresolved within thirty (30) days, it shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.
 (a) The arbitration proceedings shall be conducted in Lucknow, Uttar Pradesh;
 (b) The arbitral tribunal shall comprise a sole arbitrator mutually appointed by both parties;
 (c) The arbitration language shall be English or Hindi;
 (d) The award of the arbitrator shall be final and binding on the parties.
18.4 Subject to the above, the courts of Lucknow and the High Court of Allahabad (Lucknow Bench) shall have exclusive jurisdiction over all disputes arising from this Agreement.

19. NOTICES AND COMMUNICATIONS

19.1 All legal notices, requests, or communications shall be sent in writing to:

19.2 Notices shall be deemed duly served:
 (a) If sent by registered post, within seven (7) business days;
 (b) If sent via email, upon receipt confirmation.

20. MISCELLANEOUS PROVISIONS

20.1Entire Agreement: This Agreement constitutes the entire understanding between the parties and supersedes all prior oral or written representations.
20.2Severability: If any clause of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
20.3Waiver: No failure or delay by BOOKOURBUS in exercising any right or remedy shall constitute a waiver thereof.
20.4Assignment: Users shall not assign their rights or obligations under this Agreement without prior written consent from BOOKOURBUS.
20.5Amendment: BOOKOURBUS reserves the right to modify, update, or amend these Terms at any time without prior notice. Updated versions shall take effect immediately upon publication on the Platform.
20.6Language: This Agreement may be translated into Hindi or other languages for convenience; however, the English version shall prevail in case of any conflict.

21. DECLARATION AND ACCEPTANCE

By accessing or using the BOOKOURBUS Platform, the User confirms that they have read, understood, and agreed to the Terms of Service herein.
Continued use of the Platform implies unconditional acceptance of all terms, policies, and obligations mentioned above.
